Be prepared to be surprised Ö

The way you react to the unexpected can make all the difference in a mediation. It's the document that you did not expect to see or the person who turns up who you haven’t been told about that causes the greatest fuss.

In fact that uninvited guest could became the lynch pin of a settlement or at least a helpful catalyst for settlement.  The opposing party who was poised to walk out when they saw this happening at the beginning of the day, may be the first to say at the end of the day that a settlement may not have happened without him . So when you are surprised by something you did not expect when you first arrive at a mediation, pause and consider whether it might something you can work to your advantage or at least not reject out of hand.
