This seminar will focus on the intricate nature of insolvency disputes and how mediation can offer a more constructive and less adversarial approach to resolving conflicts. We will examine the various types of disputes commonly encountered in insolvency cases, including creditor claims, asset distribution, and corporate restructuring challenges. Special emphasis will be placed on the use of mediation as an alternative to traditional litigation, highlighting its potential to streamline processes, reduce financial strain, and provide parties with more control over outcomes. Participants will explore real-world applications of mediation, learn key strategies for successful mediation in insolvency cases, and understand the advantages it offers in achieving mutually agreeable solutions while preserving relationships in difficult circumstances.

Peter Brewer, Partner in the Dispute Resolution team, HCR

Peter is a specialist commercial litigator acting for turnaround professionals, directors and corporate stakeholders in high value and complex disputes. He has over 20 years’ experience as a commercial litigation solicitor.

Speakers:

Alexander Heylin, Barrister at No5 Barristers' Chambers

Alexander has broad commercial and insolvency litigation experience covering a wide range of contractual, property and regulatory disputes. His work includes an emphasis on civil fraud, white collar fraud, company, insolvency and regulatory matters, as well as complex commercial disputes generally.

Alex Wild, Partner in the Restructuring and Insolvency team at HCR

Alex has significant experience in both complex fraud and asset-tracing in multiple jurisdictions and non-contentious restructuring, having started his insolvency career as a stock assistant during the collapse of Woolworths.

Tim Hardy, leading Commercial Mediator at IPOS Mediation

Tim Hardy has built his mediation practice over the last 10 years alongside his private practice as a litigator with CMS, where he led the Commercial Litigation team for 21 years. He has been recognised for his mediation skills by Legal 500 and Who’s Who Legal and as a key individual by Chambers & Partners Guide.

Charlotte May, Associate Director at Manolete Partners

Charlotte is Regional Associate Director, based primarily in the South West and Wales. She is experienced in complex commercial disputes with specialist expertise in property, negligence and insolvency.
