Statutory nuisance

Public Sector & Regulatory
Background

Car racing at a disused airfield triggers complaints. The council serves a statutory nuisance abatement notice. Before the appeal hearing, the council sets up a mediation involving environmental health officers, the airfield owner and local residents.

Outcome

During discussion locals realise the value of maintaining the airfield in viable use, given the threat of housing development, but insist on respect for their peace and quiet. A noise abatement regime is agreed which requires technical changes to car specification and restricts operating hours. By consent the abatement notice and the appeal are withdrawn with no order as to costs.
