Family Business: Mediation’s Role in Securing Legacy.

Mediation is crucial for family businesses in the UAE and UK. How can it help navigate conflict and strengthen generational ties?

A recurrent theme during my recent visit to Dubai Arbitration Week was the unique challenges and conflicts faced by family businesses.  This topic is of critical importance, and we were pleased to contribute to the conversation by hosting our own event, alongside Clifford Chance, “Shaping Dialogue, Strengthening Legacy: Mediation in the Family Business Context.” At that event, we also launched the Family Business Committee of the Mediation Hub MENA, a new initiative dedicated to supporting these vital enterprises.

Our experience reinforces the belief that many conflicts inherent in family-run organisations can be effectively addressed and resolved with the help of an expert mediator.  By facilitating structured dialogue, a mediator can help to preserve relationships and secure the future of the business for generations to come.

 

The Economic Powerhouse of Family Businesses

The significance of family businesses to economies cannot be overstated. In the United Arab Emirates (UAE) alone, these enterprises are a formidable force.

  • They contribute an impressive 60% of the region’s GDP.

  • They employ 80% of the private sector workforce across the Gulf Cooperation Council (GCC).

  • Dubai is home to nearly 60% of the UAE’s family businesses.

The scale of these operations is substantial. The top ten family businesses in the region command a combined net worth exceeding $31 billion and provide employment for 600,000 people. These figures underscore a clear reality: the continued health and success of these enterprises are crucial not only for the families involved but for the stability and prosperity of the wider economy.

 

Navigating Sensitive Issues with an expert mediator

The intersection of family dynamics and commercial interests creates a complex environment where disputes can easily arise. Issues surrounding succession planning, governance structures, and the long-term vision for the business are often emotionally charged. This is where a skilled third party neutral can provide immense value.

Our conversation during Dubai Arbitration Week centred on the pivotal role that expert mediators can play in helping these businesses navigate sensitive issues.  We are not talking here about the traditional one day mediation but, instead, a process that is designed for the particular circumstances and will likely be drawn out over a period of time.  A skilled mediator creates a confidential and neutral space for family members to voice concerns, explore options, and collaboratively build consensus. This process is essential for strengthening generational understanding and ensuring that the family’s legacy is protected.

The newly launched Family Business Committee for the Mediation Hub MENA will be instrumental in this area. The committee is dedicated to supporting family enterprises by facilitating these crucial conversations around succession, governance, and legacy, ensuring they have the tools to thrive.

 

A Global Conversation: Relevance in the UK

Whilst our recent focus was on the GCC, this conversation has significant relevance globally. The United Kingdom, for instance, has a business landscape heavily shaped by family-owned enterprises.

In the UK, an astonishing 93% of all private firms are family businesses. These companies collectively employ 15.8 million people, highlighting their foundational role in the national economy. The challenges of balancing family relationships with commercial objectives are universal, making the need for effective dispute resolution mechanisms such as mediation just as critical in the UK as it is in the UAE.

Ultimately, whether in Dubai or London, the goal remains the same: to support family businesses in building a strong foundation for the future. By bringing in a skilled third party neutral, these enterprises can navigate conflict constructively, strengthen their governance, and ensure their legacy endures for generations.
